rear drivers side break problem

Heres the problem.

Today, I was driving, and I started to smell something burning, I thought maybe it was my clutch, but I don't drive with my foot on the clutch (i.e burning the clutch)

The smell got worse and worse and I looked in my side mirror and noticed a lot of smoke coming from the rear drivers side wheel.

I stopped my car and I noticed that my pads were right against the rotor. The driver side pads were closer to the rotor than the passenger side.

Possible problems after doing some research:
1. Seized Caliper
2. E-brake handle/cable is still pulled even those the handle is down
3. Stuck pads

Now, I am not a brake expert and I don't really want to bring it to the mechanic for them to charge me an arm and a leg to check something I can do myself if I knew the problem.

Now, I drove the car back home, and there was no more smoke, no more burning smell, but after I parked the car, my drivers side wheel was hotter than my passenger side wheel.
Is my wheel baring seized?

Possible help?

Anyone care to take a look at my car on Saturday? hehe

**edit**
Before this happened, I would pull the e-brake and the car doesn't seem to stay..lol
now, when I pull the e-brake, I can pull it up about 1.5 inches and hear no clicks ><

seized cable maybe? take the caliper off, and see if you can push the piston back with some channel locks, if you can, your caliper is good...also check to see if you can remove the pads by hand, if not then you should just clean up the tabs and lube them...

you may have a seized slider undo the calipers and see if the pins are free and if there not free them up and lube them

most likely your sliders are seized.
